Byrna Launcher Velocity Investigation

Migliaccio & Rathod LLP is investigating whether certain Byrna less-lethal launchers were advertised using potentially misleading projectile velocity claims, including representations about how fast projectiles travel when fired.

Byrna has advertised launcher velocities of approximately 400 feet per second (FPS). However, one consumer complained that their launcher achieved average velocities closer to 320 FPS. Byrna has explained that different advertised figures may refer to different measurements, including initial projectile velocity and averages over the first ten shots.

Migliaccio & Rathod is investigating whether consumers purchased Byrna launchers expecting the advertised velocity during ordinary use without being adequately informed about how those performance figures were measured or whether they could consistently be achieved.

Owners May Have Experienced:

  • Purchasing a Byrna launcher based on advertised projectile velocity;
  • Expecting projectiles to travel at approximately 400 FPS;
  • Measuring projectile speeds substantially below advertised figures;
  • Discovering that advertised velocity figures were based on particular testing conditions;
  • Receiving unclear explanations about initial versus average projectile velocity; or
  • Paying more for a launcher based on its advertised performance.

Potential Claims May Include:

  • Misleading representations concerning projectile velocity;
  • Failure to adequately disclose limitations on advertised performance figures;
  • False advertising concerning launcher specifications;
  • Breach of express warranty; or
  • Violations of state consumer protection laws.

Signs You May Be Affected:

  • You purchased a Byrna less-lethal launcher;
  • You relied on advertised projectile velocity when making your purchase;
  • Your launcher was advertised as achieving approximately 400 FPS;
  • You measured projectile velocities substantially below the advertised figure;
  • You believe the advertised performance differed from what you received; or
  • You purchased your launcher from a physical retail store or independent dealer.
