Migliaccio & Rathod LLP is investigating whether Shark NeverChange air purifiers, including the NeverChange Air Purifier MAX, were advertised using misleading claims about their ability to completely clean indoor air.
Certain Shark air purifiers display a “Clean Air 100%” reading, which consumers may understand to mean that all airborne pollutants have been removed. However, the reading actually indicates that detected particulate levels have fallen below the device’s sensor threshold, not that the surrounding air is completely free of pollutants. In May 2026, the National Advertising Division (NAD) determined that Shark’s advertising could mislead consumers about the meaning of the 100% reading and recommended clearer disclosures.
Migliaccio & Rathod is investigating whether consumers purchased Shark NeverChange air purifiers based on misleading representations about their air-cleaning capabilities and paid for a level of air purification that the products’ displays did not actually establish.
Consumers May Have Experienced:
- Purchasing a Shark NeverChange air purifier because of its advertised air-cleaning capabilities;
- Believing a “Clean Air 100%” reading meant all airborne pollutants had been removed;
- Relying on the purifier’s percentage display to assess indoor air quality;
- Not understanding the limitations of the device’s air-quality sensor; or
- Paying more for a purifier based on its advertised clean-air measurements.
Potential Claims May Include:
- Misleading representations concerning air purification performance;
- False advertising regarding the meaning of “Clean Air 100%”;
- Failure to adequately disclose sensor limitations;
- Breach of express warranty; or
- Violations of state consumer protection laws.
Signs You May Be Affected:
- You purchased a Shark NeverChange air purifier, including the MAX model;
- Your purifier displays a “Clean Air 100%” reading;
- You believed that reading meant the surrounding air was completely free of pollutants;
- You relied on the clean-air percentage when choosing the product;
- You paid more for the purifier because of its advertised air-quality monitoring features; or
- You have the product’s model number or purchase records.
