Migliaccio & Rathod LLP is investigating allegations that Amazon charged consumers surcharges on imported products to cover the costs of tariffs that were later ruled unlawful by the U.S. Supreme Court.
Between February 2025 and February 2026, Amazon allegedly passed tariff-related expenses on to customers through higher product prices. In February 2026, the Supreme Court ruled in Learning Resources, Inc. v. Trump that the International Emergency Economic Powers Act (IEEPA) did not authorize the tariffs imposed under that law.
Migliaccio & Rathod LLP is investigating whether Amazon customers may have paid higher prices because of these tariffs and whether affected consumers may be entitled to compensation.
Consumers May Have Experienced:
- Higher prices on imported products purchased through Amazon
- Additional costs associated with tariffs imposed between February 2025 and February 2026
- No reimbursement for tariff-related price increases
- Purchases of imported products that may have been subjected to unlawful tariff-related changes.
Potential Claims May Include:
- Unjust enrichment;
- False advertising or misrepresentation;
- Consumer overcharges;
- Failure to reimburse;
- Unfair or deceptive business practices.
Signs You May Be Affected:
- You purchased products sold directly by Amazon between February 2025, and February 2026;
- You purchased imported products, particularly items manufactured in China, Canada, Mexico, or other tariff-affected countries;
- You paid prices that allegedly reflected tariff-related increases;
- You paid higher product prices without receiving any subsequent reimbursement for tariff-related increases.
