Migliaccio & Rathod LLP is investigating reports that certain Kidde P4010-series smoke and combination smoke/carbon-monoxide alarms may be prone to repeated false alarms.
Consumers report that Kidde P4010 models can suddenly sound even when there is no smoke or fire present, including in the middle of the night. In some homes, the problem has allegedly occurred more than once or affected multiple alarms because many Kidde P4010 models are interconnected, meaning that a false alarm triggered by a single unit can cause every connected alarm in the home to sound. Kidde sold many P4010 models with sealed 10-year batteries and representations emphasizing long-term, worry-free operation.
Migliaccio & Rathod is investigating whether certain Kidde P4010-series alarms share a common design, sensor, or other defect that causes them to generate false alarms under ordinary household conditions, and whether consumers were adequately informed about the problem.
Consumers May Have Experienced:
- Alarms sounding suddenly with no smoke or fire present, including in the middle of the night;
- Repeated false alarms from the same unit or from multiple units in the home;
- Receiving replacement alarms from Kidde that later developed similar problems;
- Replacing alarms well before the end of their expected useful life;
- Incurring electrician or installation expenses, or replacing several interconnected units at once;
- Difficulty determining whether an alarm reflected a genuine emergency.
Potential Claims May Include:
- False or misleading representations;
- Breach of express warranty;
- Breach of implied warranty of merchantability;
- False advertising/failure to disclose;
- Consumer protection violations.

- You purchased or have installed a Kidde P4010-series smoke or combination smoke/carbon-monoxide alarm;
- Your alarm has sounded repeatedly without smoke or fire present;
- False alarms continued after you cleaned the alarm, checked for contaminants, or had your wiring inspected;
- You received a replacement alarm that later developed the same problem;
- You replaced one or more alarms earlier than expected or paid for an electrician or installation; or
- You have receipts, photographs, correspondence with Kidde, or other documentation of the issue.
