Migliaccio & Rathod LLP is investigating reports that Ford Mustang Mach-E vehicles equipped with BlueCruise may fail to adequately respond to stationary vehicles at highway speeds, potentially requiring drivers to intervene to avoid a collision.
The National Highway Traffic Safety Administration (NHTSA) is investigating approximately 129,000 model-year 2021–2024 Ford Mustang Mach-E vehicles equipped with Co-Pilot360 Active 2.0 and BlueCruise. The investigation concerns collisions involving Mustang Mach-E vehicles and stationary objects in the roadway.
NHTSA reported that Ford designed the Adaptive Cruise Control component of the system to inhibit a response to reported stationary objects when the vehicle’s approach speed is 62 mph or greater. Investigators are examining BlueCruise’s system limitations and drivers’ ability to respond to situations that exceed those limitations.
The National Transportation Safety Board (NTSB) has also investigated two fatal 2024 crashes involving 2022 Ford Mustang Mach-E vehicles operating with BlueCruise engaged. In both crashes, the vehicles struck stationary vehicles at highway speeds without recorded driver-applied or system-initiated braking or steering immediately before impact. The NTSB identified driver distraction, impairment, misuse, and overreliance on automation as factors in the crashes, while also identifying shortcomings involving Ford’s partial-automation and safety systems.
Migliaccio & Rathod LLP is investigating whether Ford adequately disclosed the limitations of BlueCruise to consumers who purchased or subscribed to the feature and whether Ford Mustang Mach-E owners paid for a driver-assistance system whose ability to respond to stationary vehicles was more limited than they reasonably expected.
Owners May Have Experienced:
- BlueCruise failing to slow or stop when approaching a stationary vehicle;
- The vehicle continuing toward stopped traffic at highway speeds;
- Having to suddenly brake or steer to avoid a collision while BlueCruise was engaged;
- BlueCruise issuing a warning only shortly before reaching stopped traffic;
- Unexpected or concerning behavior when approaching vehicles stopped at a red light or in traffic;
- Disabling or no longer using BlueCruise because of safety concerns; or
- Paying for a BlueCruise subscription or activation but limiting or discontinuing use of the feature because of its performance.
Potential Claims May Include:
- Failure to adequately disclose limitations of the BlueCruise system;
- Misrepresentations or omissions concerning BlueCruise functionality;
- Paying a premium or subscription fee for a feature with allegedly undisclosed limitations;
- Loss of use or diminished vehicle value; and
- Violations of applicable consumer-protection laws.
Signs You May Be Affected:
- You own or lease a 2021–2024 Ford Mustang Mach-E equipped with BlueCruise;
- Your vehicle failed to slow or stop when approaching a stationary vehicle while BlueCruise was engaged;
- You were required to suddenly brake or steer to avoid a collision;
- You experienced BlueCruise failing to respond as expected to stopped traffic;
- You stopped or substantially reduced your use of BlueCruise because of these concerns; or
- You paid for BlueCruise but believe its limitations concerning stationary vehicles were not adequately disclosed.
