Migliaccio & Rathod LLP is investigating whether hourly employees at the Aberdeen National Mixing Center operated by Frito-Lay / PepsiCo in Aberdeen, Maryland were fully paid for all required pre-shift and post-shift work activities.
Frito-Lay operates large manufacturing, warehouse, and distribution facilities that may require hourly employees to move through substantial facility areas, obtain equipment, report to assigned work locations, or complete other required activities before and after their scheduled shifts. PepsiCo currently lists Aberdeen among its employment locations and separately directs applicants for hourly Frito-Lay manufacturing positions to its hourly careers site.
What Workers Report
Workers may report:
- Walking long distances before clocking in or after clocking out;
- Being required to arrive early to reach assigned warehouse, mixing, loading, or distribution areas;
- Time spent walking between parking areas, facility entrances, timeclocks, and assigned work locations;
- Time spent obtaining required safety equipment or work gear before paid time begins;
- Time spent returning equipment, leaving assigned work areas, or walking back to timeclocks after a shift;
- Time spent waiting at required entrances, checkpoints, or work areas before clocking in; or
- Not being paid for all time spent performing required work-related activities on Frito-Lay property.
Why Workers Should Be Concerned
Hourly workers generally must be paid for all compensable work time. If employees are required to perform activities before clocking in or after clocking out, they may be losing wages and overtime pay.
