Waterford Village Mandatory Parking Fee Investigation

Migliaccio & Rathod LLP is investigating whether tenants at Waterford Village in Bridgewater, Massachusetts were required to pay a monthly parking fee that was not included in the apartment rent initially advertised to them.

Waterford Village, managed by Harbor Group Management, has identified a $35 monthly parking charge in its rental fee information, along with a $65 lock-change fee and other charges. At the same time, apartments have been advertised using monthly “starting at” rental prices that may not include the separate parking charge.

Massachusetts regulations generally require landlords to disclose the total mandatory monthly rental price when a rental price is initially presented to consumers.

Migliaccio & Rathod is investigating whether the $35 parking charge is mandatory for Waterford Village tenants and, if so, whether prospective renters were initially shown a lower monthly price before learning that they would be required to pay an additional $35 each month.

Renters May Have Experienced:

  • Renting or applying for an apartment at Waterford Village;
  • Being charged $35 per month for parking;
  • Being required to pay the parking charge even if they did not want or need parking;
  • Seeing an advertised monthly rent that did not include the parking fee;
  • Learning about the parking charge only after beginning the application or leasing process; or
  • Paying a separate $65 lock-change fee when moving in.
