Samsung Smart TV Voice Recognition Investigation

Migliaccio & Rathod LLP is investigating whether Samsung smart TV owners were adequately informed about the collection and transmission of voice commands through the television’s voice-recognition features.

Samsung smart TVs have offered voice-recognition functionality that allows consumers to search for content and control certain television functions using spoken commands.

Samsung states that its devices may capture voice commands and associated text in order to provide and improve voice-recognition features. Samsung also states that interactive voice commands are collected when a consumer makes a specific voice-search request by activating the voice feature and speaking into the microphone.

Samsung says consumers can disable Voice Recognition data collection through the television’s settings, although doing so may disable certain features.

Migliaccio & Rathod is investigating whether Samsung smart TV owners were given clear and accurate information about when voice recording begins, what audio is transmitted, how long voice information is retained, and whether disabling voice-recognition settings fully stops the collection consumers intended to disable.

Consumers May Have Experienced:

  • Owning a Samsung smart TV with voice-recognition functionality;
  • Using voice commands through a remote control or television microphone;
  • Having spoken commands transmitted for processing;
  • Disabling voice-recognition or privacy settings;
  • Being uncertain whether disabling the feature stopped audio collection; or
  • Being unaware of how long voice-command information was retained or how it was used.

Potential Claims May Include:

  • Failure to adequately disclose voice-data collection;
  • Unauthorized or inadequately disclosed audio collection;
  • Misleading representations concerning privacy settings;
  • Invasion of privacy;
  • Unfair or deceptive trade practices; and
  • Violations of applicable state privacy or wiretapping laws.
