Expedia Personalized Hotel Pricing Investigation

Migliaccio & Rathod LLP is investigating whether Expedia users may receive individualized hotel prices, discounts, or promotional offers based on their account information, travel history, browsing behavior, or other personal data.

Travel platforms may use customer data to personalize the offers and travel options displayed to individual users. Migliaccio & Rathod is investigating whether Expedia’s personalization may in some instances extend to the actual price or value of a hotel offer shown to a particular customer.

The investigation is focused on situations where travelers searching for the same hotel, dates, room type, and occupancy receive different economic terms that cannot readily be explained by ordinary changes in inventory or timing.

The source research identifies Expedia as a potential target for further investigation, although it does not establish that Expedia currently uses personal information to set individualized hotel prices.

Consumers May Have Experienced:

  • Receiving a different Expedia hotel price than another consumer;
  • Seeing different prices when logged into an Expedia account compared with searching while logged out;
  • Receiving member-only or personalized discounts;
  • Seeing different purported original prices for the same hotel;
  • Receiving a discount that did not actually produce a lower price than another user’s regular rate; or
  • Seeing repeated price differences associated with their account.

Potential Claims May Include:

  • Failure to disclose individualized pricing;
  • Misleading personalized discounts;
  • False or misleading reference pricing;
  • Unfair or deceptive trade practices;
  • Unjust enrichment; and
  • Violations of applicable state consumer-protection laws.

Signs You May Be Affected:

  • You searched for or booked a hotel through Expedia;
  • You compared your price with another traveler searching at approximately the same time;
  • Another user received a materially lower rate for the same room and dates;
  • Your displayed price differed depending on whether you were logged in;
  • You received an account-specific discount or promotional offer; or
  • You have screenshots showing different prices for otherwise identical reservations.
