Migliaccio & Rathod LLP is investigating whether Parker Meggitt properly paid hourly employees for all compensable work performed before, during, and after their scheduled shifts.
Reports provided for this investigation raise concerns about off-the-clock work by Parker Meggitt employees. The reports also indicate that employees may have received sign-on bonuses or other additional compensation. The off-the-clock allegation provides a separate potential wage issue regardless of whether any particular sign-on payment was required to be included in the overtime rate.
Hourly employees generally must be compensated for work that an employer requires or permits them to perform. This may include compensable activities performed before clocking in, after clocking out, or during periods that are treated as unpaid.
When unpaid work causes an employee’s actual hours to exceed 40 during a workweek, the Parker Meggitt employee may also be owed additional overtime compensation.
Employees May Have Experienced:
- Performing required tasks before clocking in;
- Continuing to work after clocking out;
- Performing job-related activities during unpaid periods;
- Having required work excluded from recorded hours;
- Working more than 40 actual hours without receiving overtime for all hours worked; and
- Receiving paychecks that did not reflect all compensable work performed.
Potential Claims May Include:
- Unpaid off-the-clock work;
- Failure to pay for all hours worked;
- Unpaid overtime compensation;
- Improper timekeeping practices;
- Violations of the Fair Labor Standards Act; and
- Violations of applicable state wage laws.
