Jushi / Beyond Hello Employee Tip Pool Investigation

Migliaccio & Rathod LLP is investigating whether Jushi Holdings / Beyond Hello dispensary employees may have been required to share customer tips with managers or supervisors who were not legally permitted to participate in employee tip pools.

Public employee information indicates that tips are part of employee compensation at certain Beyond Hello locations. Beyond Hello also employs retail workers in positions including Patient Consultants, Customer Consultants, Shift Supervisors, and General Managers.

Federal law generally prohibits qualifying managers and supervisors from keeping portions of other employees’ tips. This prohibition can apply even when the supervisor is paid hourly or performs some of the same customer-facing duties as ordinary dispensary employees.

Migliaccio & Rathod is investigating whether Beyond Hello Shift Supervisors or other supervisory personnel participated in the same tip pools as budtenders, Patient Consultants, pharmacy technicians, or other non-managerial employees.

Employees May Have Experienced:

  • Receiving cash or electronic tips from dispensary customers;
  • Having tips combined into a common employee pool;
  • Shift Supervisors receiving portions of pooled tips;
  • Supervisory employees working alongside budtenders and Patient Consultants;
  • Tipped supervisors directing employees or running dispensary shifts; and
  • Employees receiving pooled-tip distributions without a clear explanation of which positions participated.

Potential Claims May Include:

  • Improper supervisor or manager participation in employee tip pools;
  • Unlawful retention of employee tips;
  • Failure to distribute tips properly;
  • Violations of the Fair Labor Standards Act;
  • Violations of applicable state wage laws; and
  • Recovery of tips or other compensation owed.

Signs You May Be Affected:

  • You worked at a Beyond Hello dispensary;
  • Your location accepted customer tips;
  • Employee tips were pooled;
  • Shift Supervisors or managers received portions of pooled tips;
  • Tipped supervisors regularly directed other employees or ran shifts; or
  • Tipped supervisors participated in hiring, discipline, evaluations, scheduling, or promotions.
