Migliaccio & Rathod LLP is investigating reports that certain Club Car-branded electric utility vehicles supplied by AYRO may have experienced recurring defects, component failures, or warranty problems that left commercial and fleet customers with vehicles that did not perform as expected.
The investigation concerns vehicles in the AYRO 411 / 411x family and related Club Car Current vehicles.
This issue is unusual because Club Car itself previously sued AYRO over vehicles supplied for distribution through Club Car. Public securities filings state that Club Car alleged breaches connected to defects in vehicles supplied by AYRO and the termination of warranty support, and sought damages and indemnification for past and future customer claims.
AYRO’s own prior disclosures also state that production of the 411x ended amid, among other issues, “quality issues with certain components.”
Migliaccio & Rathod is investigating whether purchasers or fleet operators were left with repair costs, unusable vehicles, repeated component failures, or inadequate warranty remedies as a result.
Owners and Fleet Operators May Have Experienced:
- repeated mechanical or electrical failures;
- premature battery or charging-system problems;
- vehicles spending substantial time out of service;
- replacement parts becoming difficult to obtain;
- warranty support being delayed, reduced, or discontinued;
- repeated dealer visits without a permanent repair;
- being told that a vehicle or component was no longer supported;
- commercial downtime because an electric utility vehicle could not be used; or
- paying out of pocket for repairs that consumers believed should have been covered.
The available information indicates that the dispute between Club Car and AYRO involved customer-related defect and warranty issues, but the public record does not yet identify one single component that affected every vehicle.
For that reason, Migliaccio & Rathod is interested in hearing directly from owners so we can identify whether the same failures repeatedly affected particular models, production periods, or components.
Potential Claims May Include:
- defective components or vehicle systems;
- breach of express warranty;
- breach of implied warranty;
- failure to provide adequate warranty support;
- unfair or deceptive trade practices;
- loss-of-use damages; and
- repair or replacement costs.
Signs You May Be Affected:
- You purchased or operated an AYRO 411, 411x, Club Car Current, or related electric utility vehicle;
- your vehicle experienced repeated electrical, battery, drivetrain, steering, braking, or other component failures;
- you had difficulty obtaining warranty repairs or replacement parts;
- the same problem returned after one or more repairs;
- your vehicle was used commercially and downtime caused your business additional expense;
- you paid out of pocket because warranty support was unavailable or denied; or
- you have repair orders, fleet records, invoices, dealer communications, or warranty documents concerning repeated defects.
We are particularly interested in commercial and fleet purchasers because those customers may have detailed repair histories showing whether multiple vehicles experienced the same failure.
If you purchased or operated a Club Car / AYRO electric utility vehicle and experienced repeated defects or inadequate warranty support, we would like to hear from you.
