Migliaccio & Rathod LLP is investigating whether Zenbivy sleeping mattresses provide the insulation performance consumers expect from their advertised ASTM R-values, including mattresses marketed as providing approximately R5 insulation and “EN/ISO-matched performance.”
R-value allows campers to compare the insulation provided by different sleeping pads. A consumer purchasing an R5 mattress may reasonably expect it to provide thermal resistance comparable to other products carrying an R5 rating.
Zenbivy states that its mattresses are tested internally under ASTM F3340, the standardized method used for measuring sleeping-pad thermal resistance. Zenbivy has also marketed its Flex mattress as providing “R5 for EN/ISO-matched performance.”
Why This May Matter
Consumers may pay more for a sleeping mattress specifically because its advertised R-value suggests that it will perform well in cooler conditions.
Migliaccio & Rathod is interested in hearing from consumers who purchased Zenbivy mattresses based on these insulation representations but experienced thermal performance that seemed materially colder than expected.
We Are Investigating Whether:
- Zenbivy mattresses provide thermal performance consistent with their advertised R-values;
- mattresses marketed around R5 perform comparably to competing R5 products;
- consumers understood how Zenbivy determined its advertised ratings;
- representations concerning “EN/ISO-matched performance” affected purchasing decisions; and
- consumers paid a premium based on advertised insulation performance.
Potential Claims May Include:
- false or misleading advertising;
- deceptive trade practices;
- breach of express warranty;
- misleading representations concerning insulation performance; and
- price-premium or diminished-value damages.
