Campbell Soup Tariff Refund Investigation

Why Consumers Should Be Concerned

Campbell manufactures and sells a wide variety of packaged foods, including Campbell’s soups, Pace, Prego, Goldfish, Snyder’s of Hanover, Cape Cod, Kettle Brand, and other household brands. During the tariff period, manufacturers throughout the food industry cited higher costs for imported ingredients, packaging materials, and manufacturing inputs.

After the Supreme Court determined that many IEEPA tariffs were unlawful, eligible importers gained the opportunity to recover previously paid duties through the federal tariff-refund process. If Campbell receives substantial tariff reimbursements while consumers continue paying prices that reflected those same tariff costs, the company may receive both higher retail revenue and government reimbursement for the same expenses.

Consumers generally accept that temporary government-imposed costs may affect retail prices. However, when those costs are later refunded, consumers may reasonably expect companies to adjust prices or otherwise share those recovered costs rather than retaining both forms of compensation.

This investigation seeks to determine whether Campbell properly disclosed the impact of tariff refunds on consumer pricing and whether consumers paid more than they otherwise would have absent the allegedly unlawful tariffs.
