Migliaccio & Rathod LLP is investigating reports that certain bagged or bulk compost products may be contaminated with persistent herbicides that damage garden plants.
What Consumers Report
Gardeners report:
- Purchasing compost for vegetable gardens, raised beds, or landscaping.
- Tomato, bean, pea, pepper, sunflower, or other sensitive plants curling, twisting, yellowing, or dying.
- Damage appearing after compost was mixed into soil.
- Compost allegedly contaminated with persistent herbicides from treated hay, manure, or feedstock.
- Losing entire garden beds or seasonal crops.
Why Consumers Should Be Concerned
Compost is marketed as improving soil health. If compost contains persistent herbicides, it may harm the very plants consumers are trying to grow and may remain problematic in soil for months.
Potential claims may include:
- Product defect
- Breach of warranty
- Failure to warn
- Consumer protection violations
