Migliaccio & Rathod LLP is investigating EcoFlow’s marketing of “Smart Extra Batteries” for the DELTA product line, where consumers report that advertised cross-model compatibility does not function as claimed.
Reported Issues
Consumers purchasing EcoFlow DELTA 2, DELTA 2 Max, DELTA 3, and DELTA 3-series extra battery packs report:
- Promotional claims suggesting broad compatibility across DELTA models (“seamless ecosystem,” “expand your power with any DELTA battery”)
- Actual hardware limitations that allow only certain batteries to connect, or only allow one battery at a time
- Situations where an expensive extra battery cannot be used with a customer’s existing DELTA base unit without adapters or additional equipment
- Retailers (including Amazon) listing incorrect compatibility charts, leading to stranded or return-denied purchases
Because these battery packs typically cost $400-$1500, mismatched compatibility results in significant consumer losses.
Why Consumers Should Be Concerned
If EcoFlow misrepresented or overstated the compatibility of its battery ecosystem, this may violate:
- State Unfair & Deceptive Acts and Practices (UDAP) statutes
- False-advertising laws
- Implied warranty of fitness for a particular purpose
- Magnuson-Moss Warranty Act (for product warranty disputes)
Consumers may be entitled to compensation for overpayment, stranded equipment, return costs, and other out-of-pocket losses.
Signs You May Be Affected
- Purchased an EcoFlow Extra Battery for DELTA 2 / DELTA 2 Max / DELTA 3 / DELTA Pro 3 expecting cross-model compatibility
- Discovered that the battery does not connect or cannot charge/discharge as advertised
- Needed additional hardware (hubs, cables, adapters) that were not disclosed
- Were denied a refund for an incompatible battery
- Relied on EcoFlow’s or a retailer’s compatibility chart or FAQ that later proved inaccurate
