Migliaccio & Rathod LLP is investigating the presence of toxic PFAS chemicals in fitness and health wearable products marketed as safe and eco-friendly.
What’s the Problem?
Smartwatch bands and other wearable fitness accessories are often promoted as health-conscious, safe for daily wear, and environmentally sustainable. However, growing evidence suggests that some of these products—particularly those made with fluoroelastomer or synthetic sport materials—may contain dangerous levels of per- and polyfluoroalkyl substances (PFAS), also known as “forever chemicals.”
These chemicals:
-
Accumulate in the human body through skin absorption during regular wear;
-
Are linked to cancer, immune suppression, reproductive harm, and hormonal disruption;
-
Persist in the environment and the body, with no natural breakdown;
-
Are not disclosed by manufacturers, despite bold claims about safety and sustainability.
A recent class action alleges that Samsung’s Galaxy Watch bands contain high levels of PFHxA, a toxic PFAS compound, even as the company markets these bands as wellness-oriented and environmentally conscious.
Why Investigating Toxic PFAS Chemicals Matters
Consumers are encouraged to wear fitness bands all day and overnight, especially for sleep and health tracking. When companies fail to disclose that their products contain harmful PFAS:
-
Users are misled into prolonged, direct exposure to toxins;
-
They may suffer skin reactions or more serious long-term health risks;
-
They pay a premium for products falsely advertised as safe and sustainable;
-
They lose the ability to make informed purchasing decisions.
What May Be Unlawful
Marketing wearable products as “safe,” “eco-friendly,” or “health-oriented” while failing to disclose the presence of hazardous PFAS may violate:
-
State consumer protection laws;
-
False advertising statutes;
-
Environmental marketing standards;
-
Laws against fraud and unjust enrichment.
Have You Purchased a Smartwatch Band or Wearable Advertised as Safe or Sustainable?
You may have a legal claim if:
-
You purchased a smartwatch band or other wearable fitness accessory advertised as safe, sustainable, or wellness-focused;
-
The product contained PFAS or other harmful substances that were not disclosed;
-
You relied on the company’s health and environmental marketing in making your purchase;
-
You suffered physical symptoms or would not have purchased (or would have paid less) had you known the truth.
