Have You Been Charged a Paper Billing Statement Fee in New York?
If your bank or service provider has been charging you a monthly paper billing statement fee just to receive your statements by mail, you may have been unlawfully overcharged, especially if you live in New York.
Under New York General Business Law § 399-zzz, companies are prohibited from charging consumers an additional fee to receive a paper billing statement. This law has been in effect since 2011 and was enacted to protect seniors, low-income customers, and others who may not have reliable internet access or simply prefer the privacy and reliability of mail.
What the Law Says
N.Y. GBL § 399-zzz makes it illegal for any company doing business in New York to charge extra for sending a billing statement via U.S. mail. Violations are also considered deceptive practices under New York General Business Law § 349, which allows for legal action and recovery.
Why This Matters
Some banks, financial institutions, and service providers are still charging $2–$5 per month for mailed billing statements, despite the clear ban. These fees may appear on your account as:
-
“Paper Statement Fee”
-
“Mailed Statement Charge”
-
“Monthly Paper Delivery Fee”
If you’ve paid these fees as a New York resident, you’re likely entitled to reimbursement, and you may be eligible to join a class action to stop the practice altogether.
You May Have a Legal Claim If
-
You live in New York
-
You receive paper billing statements from your bank or service provider
-
You were charged a separate fee for receiving those statements by mail
