Migliaccio & Rathod LLP is investigating whether Welch’s Fruit Snacks (PIM Brands) misled consumers through commercials featuring Gordon Ramsay that implied Welch’s snacks are nutritionally superior and that competing products are essentially “worthless.”
Reported Issues
In high-visibility TV spots, Gordon Ramsay—cast as Welch’s “Chief Fruit Officer”—promoted Welch’s Fruit Snacks with messaging emphasizing “whole fruit” content and ridiculing competing fruit snacks as inferior or nutritionally insignificant.
A competitor challenge before NAD argued that the ads communicated two implied claims:
- Welch’s Fruit Snacks are superior because they contain whole fruit; and
- Competing fruit snacks are nutritionally worthless by comparison.
NAD agreed these were reasonable consumer takeaways and found no substantiation supporting the superiority or competitor-worthlessness messages. NAD recommended PIM Brands discontinue or modify the commercials.
