Migliaccio & Rathod LLP is investigating whether major musical-instrument manufacturers and retailers use Minimum Advertised Price (“MAP enforcement”) systems to keep consumer prices artificially high.
Reported Issues
Consumers note that guitars and music equipment carry identical pricing across all major retailers, with evidence suggesting coordinated MAP enforcement by manufacturers (Fender, Gibson, Yamaha, Taylor) and large retailers (Guitar Center, Sweetwater, Sam Ash, zZounds). Reports include algorithmic policing, threats of supply cuts, and simultaneous price moves.
Why Consumers Should Be Concerned
If manufacturers and retailers maintained uniform prices through coordinated MAP enforcement, consumers may have overpaid due to an anticompetitive price-fixing scheme. Such conduct may violate Sherman Act §§ 1–2, Robinson-Patman, and state antitrust law.
Signs You May Be Affected
- Purchased musical gear from major retailers since 2019
- Observed identical pricing across all sellers
- Were denied price matching based on MAP enforcement rules
