Illinois Staffing Agencies Wage-Fixing Investigation

Illinois Staffing Agencies Accused of Illegal No-Poach and Wage-Fixing Practices

According to a lawsuit filed by the Illinois Attorney General’s Office, led by Kwame Raoul, the staffing agencies colluded to:

  • Enter into no-poach agreements promising not to hire or solicit each other’s temporary employees

  • Engage in wage-fixing, setting artificially low pay rates for temporary workers

  • Coordinate with Colony Display LLC, a manufacturing client, which allegedly facilitated and enforced these anticompetitive agreements.

These actions harmed workers by limiting job mobility and suppressing fair wages, violating state and federal antitrust laws.

Settlements Total $5.5 Million to Compensate Affected Illinois Workers

The lawsuit has resulted in a series of settlements across the involved parties:

  • Colony Display Settlement (2023): $1.2 million paid to affected workers with compliance reforms.

  • Elite Staffing Settlement (August 2024): $1.5 million settlement with obligations to end no-poach and wage-fixing.

  • Metro Staff Settlement (November 2024): $1.8 million paid alongside mandated reforms to protect worker freedom.

  • Midway Staffing Settlement (June 27, 2025): $1 million compensation and compliance measures; fully resolved the litigation.

Together, these settlements total $5.5 million in recovered funds for impacted workers and include reforms to prevent future collusion.
