Colony Display Wage-Fixing Investigation

Colony Display Allegedly Facilitated Anticompetitive Agreements to Suppress Wages and Worker Mobility

According to a complaint filed by the Illinois Attorney General’s Office in 2020, led by Kwame Raoul:

  • Colony Display acted as an intermediary, communicating and enforcing agreements between staffing agencies

  • The staffing agencies agreed not to hire or solicit each other’s temporary workers (no-poach agreements)

  • They engaged in wage-fixing, setting artificially low pay rates, which suppressed competition, worker mobility, and fair wages.

These practices violate the Illinois Antitrust Act and harm temporary workers by limiting their employment options and earning potential.

Key Developments & Settlement

  • On November 20, 2023, Colony Display agreed to a $1.2 million settlement with Illinois to compensate affected temporary workers;

  • Colony also committed to structural reforms, enhanced compliance procedures, and a permanent ban on no-poach and wage-fixing conduct;

  • The Illinois Supreme Court upheld the state’s interpretation of the law, confirming these agreements are per se violations of the Illinois Antitrust Act;

  • The case was sent back to circuit court to continue litigation against the implicated staffing agencies.
