Migliaccio & Rathod LLP is involved in the Conyers Bio-Lab, Inc. Fire investigation that affected not only the approximate 17,000 residents who were told to evacuate, but also the 90,000 people who reside in Conyers, Georgia who were forced to shelter in place.
The BioLab Fire Incident
Around 5:30 a.m. on Sunday morning, a fire erupted on the roof of one of BioLab’s facilities in Rockdale County, Georgia. BioLab produces pool and spa treatment products, which rely in large part upon chlorine.
The Conyers, Georgia, BioLab fire triggered the sprinkler system at the facility, which caused the water to mix with a “water-reactive chemical” inside the facility. This exacerbated the issue and caused a large plume of smoke to spread from the building. This smoke spread throughout the county, becoming a hazard for residents.
After the fire began an evacuation order covering 8 square miles (highlighted in red in the map above) was issued for approximately 17,000 people living in the vicinity of the plant. The entire county of more than 90,000 residents was placed under a shelter-in-place order. Rockdale’s Emergency Management Agency extended that order into Monday, and schools in the area were shut down as well. A shelter-in-place order was reinstituted in some respects again on Tuesday based on changes in wind and weather.
Late Monday evening, Migliaccio & Rathod, with several other firms, filed a class action lawsuit seeking redress for the dangerous exposure to hazardous chemicals faced by members of the community. The lawsuit is brought under a number of theories and demands and seeks compensation for the victims of this disaster. Damages sought in the lawsuit include for the displacement of residents who were evacuated, lost wages for those who had to shelter and were unable to work, loss of revenue and business interruption for businesses that were closed, impacts on property from any contamination, and the possible need for medical monitoring of those who have been exposed to the hazardous chemicals.
