Fidelity Investments Life Insurance Company Data Breach Investigation

Migliaccio & Rathod LLP is involved in the Fidelity Investments Life Insurance Company (“Fidelity”) data breach investigation, for a data breach affecting 28,268 individuals and their personal information.

Fidelity learned of unauthorized activity on the Infosys McCamish, LLC (“IMS”) computer systems in November 2023. IMS a third-party service provider Fidelity uses in the administration of life insurance policies. On February 13, 2024 (after an IMS investigation), Fidelity discovered that a cybercriminal(s) had accessed IMS systems containing customers’ personal data between October 29, 2023, and November 2, 2023. Fidelity is unsure of what specific information was stolen.  However, the compromised information may include names, Social Security numbers, states of residence, bank account and routing numbers (if provided in furtherance of life insurance policy payments), and dates of birth.

Fidelity Investments Life Insurance Company recently began informing individuals of this breach through a mailed notice letter. All of the information stolen is likely valuable and dangerous to affected victims. In previous data breaches, victims of data theft have noticed identity theft attempts ranging from fraudulent charges on bank accounts or credit cards, to unauthorized credit card applications, to medical services or government services ordered in their name, to their information being posted on the dark web, to a massive uptick in the number of spam text messages, calls and emails received.
