Migliaccio & Rathod LLP is currently investigating the Texas-based Baptist Health System, which recently reported that Baptist Medical Center in San Antonio, Texas, and Resolute Health Hospital in New Braunfels, Texas (collectively, “Baptist”) experienced a cybersecurity incident involving personal information related to services patients may have received at one of their locations. An investigation into the data breach found that unauthorized individuals not only gained access to certain systems within their network, but were also able to gain access to personal information and remove some data from the network between March 31 and April 24. The impacted information includes the following: full names, dates of birth, addresses, Social Security numbers, health insurance information (such as the name of insurer/government payor and the policy and/or group number), medical information (such as medical record numbers, dates of service, provider and facility names, chief complaint or reason for a visit, and other visit procedure and diagnosis information), and billing and claims information.
Baptist only recently began notifying victims of the incident. Due to this lapse in time between the data breach and the notice to affected patients, as well as the almost month-long access the unauthorized cybercriminal(s) had to the information, hackers may have already been able to acquire and sell the impacted sensitive information and otherwise benefit from the fraudulent misuse of such information. Some individuals affected by the data breach may have already noticed (or may soon notice) one or more of the following types of fraudulent activity related to their personal and health information: unauthorized credit card inquiries and/or charges, requests for loans or benefits in a patient’s name without their consent, fake medical procedures ordered, and/or disrupted use of the institution’s website or patient portal.
