Migliaccio & Rathod LLP is currently investigating medical, homeowner, and automobile insurance companies, for failing to safeguard sensitive customer information in recent data breaches affecting hundreds of thousands of individuals. In just one example, the dental insurance company Healthplex, Inc. reported a data breach affecting 76,262 customers in April of 2022. These breaches occur when companies receive and process sensitive customer information during insurance claims evaluation or when customers sign up for insurance services through their employer or doctor’s office. Recent data breaches have involved extremely sensitive customer information that can be used to perpetrate identity theft in the wrong hands—including names, addresses, member ID numbers, plan affiliations, dates of birth, dates of service, provider names, prescription drug names, Social Security numbers, banking information, credit card numbers, usernames and passwords for the companies’ member portals, email addresses, phone numbers, and driver’s license numbers.
In the wake of a data breach, customers are often sent a letter that discloses the issue. Sometimes a remedy such as credit monitoring is offered for a short period of time. The remedy—if there is one—is often inadequate because it fails to provide any compensation for out-of-pocket losses, lost time dealing with the issue, and the long-term risk posed by confidential information such as social security numbers and other sensitive financial information being in the hands of cybercriminals. In previous data breaches, victims of these attacks have noticed identity theft attempts ranging from fraudulent charges on bank accounts or credit cards, government services ordered in their name, or their information being posted on the dark web.
