Migliaccio & Rathod LLP is currently investigating the Neptune, New Jersey-based dialysis center Dialyze Direct for failing to safeguard sensitive patient information in a data breach that occurred before January 21, 2021 and March 4, 2021. The incident occurred when the dialysis and nephrology company discovered that an unauthorized actor had accessed an employee email account and had viewed patient information. An investigation into the attack found that the unauthorized actor had gained access to files that contained names, dates of birth, Social Security numbers, government identification numbers, financial account information, payment card information, and medical information that potentially includes financial identification numbers, medical diagnostic and treatment information, and/or health insurance plan information.
Although Dialyze Direct investigated the incident and determined that patient information had been accessed, the company’s announcement of the incident notes that the data breach occurred between January and March of 2021, approximately one year before any attempt to notify affected individuals. Due to the lapse in time between the breach and the company’s notice to affected patients, hackers may have already been able to acquire and sell sensitive patient information such as social security numbers. In previous data breaches, victims of data theft have been forced to spend money on credit monitoring services or other fraudulent charges. Some individuals affected by the data breach at Dialyze Direct may have noticed one or more of the following types of fraudulent activity related to their healthcare or financial information: unauthorized credit card charges, requests for loans or benefits in a patient’s name without their consent, fake medical procedures ordered, and/or disrupted use of the institution’s website or patient portal.
