Migliaccio & Rathod LLP is currently investigating the Oradell, New Jersey-based New Jersey Brain and Spine Center (“NJBS”) for failing to safeguard sensitive patient information in a data breach that occurred in November of 2021. The incident occurred when the neurosurgery center discovered that a subset of the files on its network had been encrypted and were inaccessible. An investigation into the attack found that an unauthorized actor had gained access to files that contained names, addresses, dates of birth, email addresses, telephone numbers, social security numbers, financial account information, debit or credit card information, driver’s license numbers or other ID numbers, and medical information.
Although NJBS investigated the incident and determined that patient information had been accessed, the neurosurgery center still has not sent notification letters to affected individuals about whether their information was involved. Due to the lapse in time between the breach and the company’s notice to affected patients, hackers may have already been able to acquire and sell sensitive patient information such as social security numbers. In previous data breaches, victims of data theft have been forced to spend money on credit monitoring services or other fraudulent charges. Some individuals affected by the data breach at New Jersey Brain and Spine may have noticed one or more of the following types of fraudulent activity related to their healthcare or financial information: suspicious credit card charges, requests for loans or insurance claims filed in a patient’s name without permission, medical procedures ordered without consent, and/or disrupted use of the center’s website.
